La Salle City Council amends ordinance on cannabis possession

La Salle City Council met Monday, Nov. 21.

The La Salle City Council includes the mayor and eight council members — two each from each of the city’s four wards. Regular meetings are held at 7 p.m. every other Tuesday in city council chambers, 745 Second St.

MINUTES OF THE REGULAR MEETING OF THE LA SALLE CITY COUNCIL HELD IN THE COUNCIL CHAMBERS, 745 SECOND STREET, LA SALLE, IL. 7:00 P.M., Monday, November 21, 2016

The meeting was called to order at 7:02 p.m.

PLEDGE OF ALLEGIANCE

ROLL CALL Present- Alderman Demes, Ptak, Reynolds, Lavieri, Duncan, Herndon, Schneider Excused Absence: Mayor Grove, Alderman Bacidore A quorum was present.

Moved by Alderman Lavieri and seconded by Alderman Schneider to appoint Tom Ptak as Mayor Pro- tem in the absence of Mayor Grove. ROLL CALL: AYE: Alderman Demes, Ptak, Reynolds, Lavieri, Duncan, Herndon, Schneider NAY: None Absent: Alderman Bacidore Abstain: None Motion Carried 7-0

APPROVAL OF MINUTES Moved by Alderman Demes and seconded by Alderman Reynolds that the minutes of the regular City Council meeting held on Monday, November 7, 2016 and the Special Meeting of the City Council held Wednesday, November 9, 2016 are accepted and placed on file. Each and every alderman has a copy. Voice vote, all ayes. Motion carried.

PETITIONS Moved by Alderman Herndon and seconded by Alderman Demes to grant the request of Ameren Illinois to break ground at 116 7th Street to retire gas service. Each and every alderman has a copy. Voice vote, all ayes. Motion carried.

Moved by Alderman Demes and seconded by Alderman Herndon to grant the request of Designs and Signs for a Sign Permit to install four single faced, non-illuminated wall signs at 851 First Street and move the current wall sign located at 117 Joliet Street to the new location. Each and every alderman has a copy. ROLL CALL: AYE: Alderman Demes, Ptak, Lavieri, Duncan, Herndon, Schneider NAY: None Absent: Alderman Bacidore Abstain: Alderman Reynolds Motion Carried 6-0

REPORT OF CITY OFFICERS Moved by Alderman Lavieri and seconded by Alderman Schneider to accept and place on file the Monthly Police Income Report for October 2016 showing total fees collected of $3,345. Each and every alderman has a copy. Voice vote, all ayes. Motion carried.

COMMUNICATIONS Clerk Brown read a thank you from the family of Fran Baratta.

Moved by Alderman Lavieri and seconded by Alderman Duncan to accept and place on file the Illinois Department of Revenue Report showing sales tax collected for August 2016 of $90,522.04 and referendum approved sales tax of $40,799.54 for a total of $131,321.58. Each and every alderman has a copy. Voice vote, all ayes. Motion carried.

OLD BUSINESS No old business was brought forth.

NEW BUSINESS A straw vote was taken on a request for a sign permit from Quilting in the Valley for a 3’ x 6’ single faced, non-illuminated, wall sign that is being moved from the location at 127 Gooding to the new location at 1157 First Street. The request came in after the agenda was finalized. All aldermen were in favor.

Alderman Duncan referred the issue of removing the 15 minute parking sign located in front of 117 Gooding Street to the Streets, Alleys and Traffic Committee for further consideration.

The Streets, Alleys and Traffic Committee will meet at 6:45 p.m. on Monday, December 5, 2016.

Mayor Pro-Tem Ptak announced that the Celebration of Lights drive thru Christmas display will open at 5:00 p.m. on Tuesday, November 22, 2016. He also thanked, on behalf of Mayor Grove, all the City workers, department heads and volunteers for their efforts. Mayor Pro-Tem Ptak stated that Mayor Grove was not in attendance at tonight’s meeting in order to attend his daughter’s school concert. Alderman Schneider reminded everyone that November 26, 2016 is Small Business Saturday and stated that gift wrapping will be offered at City Hall from 11-3 for any gifts purchased that day. In addition, 50/50 tickets will be sold at City Hall. Lastly, Miracle on First is scheduled for Saturday, December 3, 2016 with an early bird $500 drawing from 50/50 entries during the tree lighting ceremony. Mayor Pro-Tem Ptak wished everyone a Happy Thanksgiving.

ORDINANCES AND RESOLUTIONS Moved by Alderman Duncan and seconded by Alderman Herndon to approve and place on file Ordinance 2666: An ordinance Enacting and Adopting an Additional Supplement to the Code of Ordinances for the City of La Salle and related matters. Each and every alderman has a copy. ROLL CALL: AYE: Alderman Demes, Ptak, Reynolds, Lavieri, Duncan, Herndon, Schneider NAY: None Absent: Alderman Bacidore Abstain: None Motion Carried 7-0

Ordinance 2666: Enacting and Adopting an Additional Supplement to the Code of Ordinances for the City of La Salle. (S-5)

A brief discussion took place prior to the vote on the ordinance relating to the possession of cannabis. Attorney McPhedran stated that this is being brought forth pursuant to an amendment done to the statute within the last year. Surrounding communities have amended their ordinances as well. Alderman Duncan questioned why the fine in this ordinance is lower than in the previous ordinance. Attorney McPhedran indicated that the statute reads that fines can be $100-$200 which is consistent with what we have generally asked for on a first offense. Alderman Duncan asked that in a year we review how many violations we have had and possibly reconsider the fine amount.

Moved by Alderman Herndon and seconded by Alderman Schneider to approve and place on file Ordinance 2667: An Ordinance Amending Provisions of La Salle City Code of Ordinances concerning the Possession of Cannabis. Ordinance 2667: Amending Provisions of La Salle City Code of Ordinances concerning the Possession of Cannabis.

COMMENTS Mr. Keenan inquired as to the schedule for garbage pick-up with the holiday. John Duncan stated that those who have Thursday pick-up will be picked up on Friday. Mr. Keenan also asked about the Rotary Park display. City Engineer Brown stated that it has grown substantially and Mr. Duncan added that the road around the display is now paved. There were no other comments from the public.

7:20 p.m. Moved by Alderman Schneider and seconded by Alderman Reynolds to exit regular session and enter into Executive Session Regarding pending and/or potential imminent litigation and related matters: Collective bargaining and related matters, and acquisition and/or sale of city real estate and related matters and the employment, appointment, performance and/or compensation of non-union personnel and related matters pursuant to the Open Meetings Act including 5-ILCS 120 Section 2(c)1- 3,5,6,and 11 thereof. ROLL CALL: AYE: Alderman Demes, Ptak, Reynolds, Duncan, Lavieri, Herndon, Schneider NAY: None Absent: Alderman Bacidore Abstain: None Motion Carried 7-0
