City of Earlville Council met Dec. 11.

Here is the minutes provided by the Council:

Call to Order and Pledge of Allegiance

Mayor Michael Hall called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance.

Mayor Hall advised Aldermen to use the microphone, informed visitors that a speaker was available, and advised public voice speakers to use the microphone.

Roll Call

The following members were present: Alderman Mark Actis, Alderman Robin Auston, Alderman Michael Goodbred, Alderman Edward Farley, Alderman Chuck Jenkins, and Alderman Steven Osborn. Also present were City Attorney Mark and Treasurer Bruce Bauer.

Visitors at the meeting were Sheila Jenkins, Pat Powell, Tom King, Ken Bonine, Mike Konsoer, Chief Darin Crask, Martha Dankenbring (Deputy Clerk) and Stu Bloom (Earville Post)

Approval of Minutes

Alderman Actis made a motion, seconded by Alderman Austin to accept the November 13, 2019, Regular Session Minutes. All in favor by voice vote. Motion Carried.

Alderman Jenkins made a motion, seconded by Alderman Goodbred, to approve the treasurer’s report as presented by Treasurer Dr. Bruce Bauer for November 2019 and place it on file. All in favor by voice vote. Motion Carried.

Review Accounts Payable and Motion to Pay Bills as Presented

Alderman Austin made a motion, seconded by Alderman Actis, to pay all bills as presented. On roll call: Alderman Austin - aye, Alderman Actis - aye, Alderman Osborn - aye, Alderman Goodbred - aye, Alderman Farley - aye, and Alderman Jenkins - aye. Motion Carried.

Public Voice

Mr. King expressed disappointment in the zoning hearing: no handouts and legalizing weed sales. He said there will be potheads and it leads to drugs and over dose.

Committee Reports / Actions Items

Finance

Alderman Austin made a motion, seconded by Alderman Jenkins, to pass Ordinance No. 12-11-2019 an Ordinance Levying Taxes for the City of Earville, LaSalle County, Illinois for the Fiscal Year Beginning May 1, 2019 and Lending April 30, 2020. On roll call: Alderman Austin - aye, Alderman Jenkins - aye, Alderman Farley - aye, Alderman Osborne - aye, Alderman Goodbred - aye, and Alderman Actis - aye. Motion Carried.

Unfinished Business

Mayor Hall read a recommendation from the Zoning Board of Appeals 5:00 p.m., December 10, 2019, meeting in regard to Zoning Ordinance amendments concerning Adult-Use Cannabis.

Alderman Actis made a motion, seconded by Alderman Austin, to accept the Zoning Board of Appeals recommendations to allow the ordinance amendments concerning Cannabis. On roll call: Alderman Actis - aye, Alderman Goodbred - nay, Alderman Austin - aye, Alderman Jenkins - aye, Alderman Farley - nay, and Alderman Osborne - aye. 4:2. Motion Carried.

Alderman Actis made a motion, seconded by Alderman Osborne, to pass Ordinance No. 12-11-2019 (A) An Ordinance Amending the Municipal Code of the City of Earville by the Addition of Chapter 10, Article VI, Cannabis Business Establishments. On roll call: Alderman Jenkins - aye, Alderman Osborne - aye, Alderman Farley - nay, Alderman Actis - aye, Alderman Goodbred - nay, and Alderman Austin - aye 4:2. Motion Carried.

Alderman Osborne made a motion, seconded by Alderman Actis to pass Ordinance No. 12-11-2019(B) An Ordinance Amending Chapter 44 Zoning of the Code of Ordinances of the City of Earville, Illinois Pertaining to Medical and Adult Use Cannabis. On roll call: Alderman Austin - aye, Alderman Goodbred - nay, Alderman Actis - aye, Alderman Farley - nay, Alderman Osborne - aye, and Alderman Jenkins - nay. Mayor Hall - aye 4:3 Motion Carried.

Alderman Austin made a motion, seconded by Alderman Actis, to pass Ordinance No. 12-11-2019(C) An Ordinance Amending the Code of Ordinances of the City of Earville by the Addition of Chapter 10, Article I, Sec 10-4 Imposing a Municipal Cannabis Retailers’ Occupation Tax. On roll call: Alderman Osborne - aye, Alderman Farley - aye, Alderman Jenkins - aye, Alderman Austin - aye, Alderman Goodbred - nay, Alderman Actis - aye F:1 Motion Carried

New Business

Alderman Jenkunds made a motion, seconded by Alderman Farley, to set the Committee of the Whole meetings on the first Wednesday of each month of 7:00 p.m. and the City Council meeting on the second Wednesday of each month of 7:00 p.m. at City Hall, with the exception of the month of January having the Committee of the Whole meeting on the second Wednesday and the City Council meeting on the third Wednesday (due to the 1st January being New Year’s day) and in November the City Council meeting on the third Wednesday (due to Veteran’s Day). The Zoning Board of Appeals meets when needed. All in favor by voice vote. Motion Carried.

At 7:26 p.m., Alderman Jenkins made a motion, seconded by Alderman Actis to adjourn the meeting. All in favor by voice vote. Motion Carried
