Sandwich City Council discusses proposed insurance survey

At a recent meeting, the Sandwich City Council discussed a proposal to survey city employees on whether they're interested in having extra insurance coverage on top of the city's plan.

Mayor Olson called the meeting to order at 7:00 PM.

Approval of Minutes

Motion was made by Alderman Scheidecker and seconded by Alderman Redden to approve the minutes of the Regular Council Meeting of July 25, 2016 and the Committee-of-the-Whole Meeting of August 1, 2016. Approval of August Semi-Monthly Bills

Motion was made by Alderwoman Killey, and seconded by Alderman Dell, approving payment of the August semi-monthly bills in the total amount of $ 115,417.47. Aye: Aldermen Dell, Fraser, Killey, McMahon, Moran, Redden, Robinson & Scheidecker Nay:0 Motion carried 8:0

Mayor Olson

Insurance Survey Proposal: Mayor Olson explained that City Hall has been inundated with insurance companies offering benefit proposals similar to the presentation made at the August 1st meeting before the Council. Rather than have each organization make a private presentation, the Mayor suggested circulating a survey to the employees to see if there is an interest for additional accident insurance, deferred compensation, or additional life insurance over that offered by the City. In fairness to those companies that have approached the City, the Mayor suggested a “benefits fair’ in the fall for all of the insurance companies to make their presentation before the employees.

Director of Public Works & City Engineer Horak: In the absence of the City Engineer, Mayor Olson provided the report.

Plan Commission regular meeting for Tuesday, August 9th, 2016, has been canceled.

Motion to Rescind May 9, 2016 Action: Mayor Olson request a motion to rescind the May 9, 2016 motion that authorized the electronics recycling agreement between New Life Electronics Recycling Inc. and the City of Sandwich. The initial motion was authorizing the City to enter into an agreement with New Life Electronics; however, the City has never received the agreement.

Motion made by Alderman Dell, and seconded by Alderman McMahon, to rescind the motion of May 9, 2016, authorizing the City to enter into an electronics recycling agreement between New Life Electronics Recycling Inc. and the City of Sandwich. Aye: Aldermen Dell, Fraser, Killey, McMahon, Moran, Redden, Robinson & Scheidecker Nay:0 Motion carried 8:0

Electronic Recycling: The next recycling collection will be held on Saturday, August 13th, 2016 from 12:30 pm – 2:30 pm at the Duvick Avenue water tower located at 750 N. Duvick Avenue.

Brush Pickup: Brush pickup is complete for Ward 2. The next collection will be the week of September 12th.

Center Street – Green to Main Reconstruction Project: The contractor is scheduled to complete sidewalk repair by the end of August.

Wastewater Treatment Plant: More details will be forthcoming regarding the completion on the switch of the oxidation ditches. The City received help from the City of Plano, and the Mayor suggested a thank you letter for their assistance on this project.

2016 Water Tower Painting / Notice to Proceed & Contract Approval: On the recommendation of Engineer Horak, Mayor Olson requested a motion to issue the “Notice to Proceed” and approve the contract for the “750,000-Gallon Spheroid, Exterior Overcoat, Wet Interior Repaint, Dry Interior Partial Repaint, and Miscellaneous Repairs” (2016 Water Tower Painting) Project with L&T Painting Company Inc. of Shelby Township, Michigan.

So moved by Alderman Redden, and seconded by Alderman McMahon. Aye: Aldermen Dell, Fraser, Killey, McMahon, Moran, Redden, Robinson & Scheidecker Nay:0 Motion carried 8:0

MFT (Motor Fuel Tax) Contract 16-00000-01-GM: 2016 Concrete Street Maintenance bid opening is scheduled for Tuesday, August 9th at 10:30 AM.

MFT Contract 16-00000-02-GM: 2016 Hot-Mix Asphalt Street Maintenance bid opening is scheduled for 10:0 AM on Tuesday, August 9th, 2016.

Pratt Road Bridge: The application for the year 2022 Major Bridge Program Application is due September 15, 2016. The City had made application in the past, and will continue to do so with funding eventually being awarded. This year’s budget has funds reserved toward the bridge maintenance.

BNSF (Burlington Northern Santa Fe) ROW (Right of Way) at Main & Lafayette Streets Water Main Replacements: Notice to Bidders will be forwarded to the paper in the next few days.

Chief Bianchi

Dacra Computer System & Software Agreement: Chief Bianchi requested a motion to approve the software for the proposed adjudication system.

Ordinance 2016-09 entitled “An Ordinance Creating a New Chapter 90 to the City Code of the City of Sandwich, Illinois “Administrative Adjudication of Non-Vehicular Code Violations” presented for motion to pass. Initially the Ordinance was presented as an amendment to Chapter 1 “General Provisions” of the City’s Municipal Code creating a new Section 15. After further review, the City Attorney, Mayor and City Clerk felt a new chapter should be created to accommodate the new adjudication process. Only the title of the ordinance has been changed, and the contents of the initial ordinance remains the same.

Alderman Scheidecker made a motion to pass Ordinance 2016-09, as amended. Motion was seconded by Alderman Moran. Aye: Aldermen Dell, Fraser, Killey, McMahon, Moran, Redden, Robinson & Scheidecker Nay:0 Motion carried 8:0

Ordinance 2016-10 entitled “An Ordinance Amending Chapter 74 “Motor Vehicles and Traffic” of the City Code of the City of Sandwich, Illinois, to Create a New Article IX, “Administrative Adjudication”. Ordinance was amended to correct a scrivener’s error correcting the amendment to read “Chapter 74” instead of the initial “Title 6”. Chief Bianchi requested a motion to pass, as corrected.

So moved by Alderman Scheidecker, and seconded by Alderman McMahon. Aye: Aldermen Dell, Fraser, Killey, McMahon, Moran, Redden, Robinson & Scheidecker Nay:0 Motion carried 8:0

Ordinance 2016-11 entitled “An Ordinance Amending Chapter 74 “Motor Vehicles and Traffic” of the City Code of the City of Sandwich, Illinois, to Create a New Article X, “Vehicle Seizure and Impoundment” and a New Article XI, “Eligibility of Towing Companies to Tow Abandoned, Wrecked, Disabled or Impounded Motor Vehicles” presented for a motion to pass. Similar to the previous ordinance, Ordinance 2016-11 was amended to correct a scrivener’s error correcting the amendment to read “Chapter 74” instead of the initial “Title 6”.

Motion made by Alderman McMahon to pass Ordinance 2016-11, as corrected. Second was made by Alderman Dell. Aye: Aldermen Dell, Fraser, Killey, McMahon, Moran, Redden, Robinson & Scheidecker Aye:0 Motion carried 8:0

National Night Out Update: The event was held on Tuesday, August 2nd. Chief Bianchi felt it was a good turnout for the first year the police department, fire department and City of Sandwich hosted. Over $1,000 was raised for FVOA (Fox Valley Older Adults).

Alderman Scheidecker felt, after discussions with IT personnel Karen Barker, that the aldermen should be utilizing the City’s host name for their e-mail address. This would require each alderman to create a new e-mail account with the host name of “sandwich.il.us” as part of their e-mail address. Several aldermen opposed the suggestion saying they already had numerous e-mail accounts and passwords stressing there was no need for an additional e-mail account. Clerk Ii noted that by law under the Open Meetings Act, an e-mail address must be posted on the city’s website for the aldermen. Last year during a discussion on the new law, Council was given a choice of listing their personal e-mail address, a ‘common’ city e-mail address or create a new e-mail address using the City’s host address. At the time, the Council favored using a general city e-mail address.

Audience Comments

Resident Todd Latham approached the Council with concerns about comments made earlier in the day by WSPY pertaining to the proposed Hall Street Lofts. As he understood it, the WSPY news commentary alluded that the City will not be paying impact fees from the project to the schools. Additionally, the reporting stated that a building permit was issued before payment was received for building permit fees.

Mayor Olson said it was not unusual to issue a building permit prior to receiving fees, but added that the City has received payment since last week’s meeting. The developer had not yet purchased the property and part of the contract was the ability to obtain a building permit. Closing was held on August 5th.

There will be no impact fees collected on this project. It was explained that impact fees are collected as part of an annexation agreement. This property, however, is already located within the corporate city boundaries, and subsequently an annexation agreement is not required. The City provided the developer with amounts of what the impact fees would have been noting the fees would be ‘voluntary fees’. This means the developer has the choice of voluntarily paying fees to the schools, for example, or refusing. On this particular project, the developer has chosen not to pay the voluntary fees to the schools, city, fire department or library. The City cannot legally force the developer to pay these fees.

Mr. Latham requested verification that the relocation of the water and sewer lines across this property were to be at the developer’s expense. This was confirmed by the Mayor.

There being no further business to come before the Council, motion made by Alderman Robison and seconded by Alderman Redden to adjourn the Regular Council meeting at 7:35 PM. Motion carried unanimously by viva voce vote.
