City of Ottawa City Council met March 17.

Here is the minutes provided by the council:

Present: Wayne A. Eichelkraut Jr., Thomas G. Ganiere, Marla K. Rodriguez, James J. Less, and Mayor Daniel F. Aussem.

Absent: None.

Commissioner Eichelkraut presented minutes of previous meeting.

Moved by Commissioner Eichelkraut that the minutes of a regular meeting of the Council of the City of Ottawa, Illinois, held on Tuesday, March 3, 2020, and the minutes of a special meeting held on Tuesday, March 10, 2020, both be approved as recorded in the permanent files of the City Clerk.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Biweekly Salary Payroll.

Moved by Commissioner Eichelkraut that the Biweekly Salary Payroll of

March 6, 2020, in the amount of $390,227.83, be approved and warrants issued. Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Monthly Expense Report.

Moved by Commissioner Eichelkraut that the Monthly Expense Report of

March 17, 2020, showing expenses in the amount of $728,616.43, be approved and warrants issued.

Second by Less.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Monthly Salary Payroll.

Moved by Commissioner Eichelkraut that the Monthly Salary Payroll of March 9, 2020, in the amount of $2,339.21, be approved and warrants issued.

Second by Rodriguez.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Monthly Financial Report.

Moved by Commissioner Eichelkraut that the Monthly Financial Report of City Clerk, Shelly L. Munks, for the month of February 2020, be received and placed on file. Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Resolution.

Moved by Commissioner Eichelkraut that a Resolution authorizing the execution of an engagement agreement between the City of Ottawa and Brian Zabel & Associates P.C., regarding the fiscal year 20 audit, be received and placed on file for public inspection. Second by Less.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Resolution.

Moved by Commissioner Eichelkraut that a Resolution authorizing the execution of a memorandum of understanding between the City of Ottawa and Tri County Opportunities Council, regarding NCAT, be received and placed on file for public inspection.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Ganiere presented Request.

Moved by Commissioner Ganiere that the City Clerk be authorized to advertise for Bids for the Long Term Control Plan Sewer Separation Element 8.2 for Canal Street and Norris Drive. Bids will be received until Wednesday, April 15, 2020, at 10:00 a.m.

Second by Rodriguez.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Ganiere presented Resolution.

Moved by Commissioner Ganiere that a Resolution authorizing the execution of an intergovernmental agreement for the emergency supply of water from the City of Ottawa to the Village of Naplate, which has been on file for public inspection since

March 10, 2020, be adopted.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Ganiere presented Estimate.

Moved by Commissioner Ganiere that the Estimate received from Layne Christensen Company in the amount of $64,908.00 for Well #11 pump repair, be placed on file and paid for from the Water Fund.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Less presented Resolution.

Moved by Commissioner Less that a Resolution authorizing the execution of an intergovernmental contract to create the Central Illinois Police Training Center, be received and placed on file for public inspection.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Less presented Resolution.

Moved by Commissioner Less that a Resolution authorizing the execution of an intergovernmental agreement for mutual aid between the City of Ottawa and the City of Marseilles, be received and placed on file for public inspection.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance amending Section 10-13 and Section 10-41 of the Municipal Code of the City of Ottawa, LaSalle County, Illinois, regarding alcohol delivery and curbside pickup for Class C & Class R liquor license holders only, be passed and approved.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance amending Chapter 26 and Chapter 28 of the Municipal Code of the City of Ottawa, LaSalle County, Illinois, regarding paraphernalia and illegal cannabis, be passed and approved.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance establishing temporary executive powers to the Mayor pursuant to State Statute 65 ILCS 5/11 1-6, be passed and approved. Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution authorizing the execution of an agreement for professional services between the City of Ottawa and BCA Architects Ltd., regarding the City’s façade program, which has been on file for public inspection since March 3, 2020, be adopted.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution approving and authorizing the execution of employment agreements for appointed city officials, which has been on file for public inspection since March 3, 2020, be passed and approved.

Second by Rodriguez.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution granting an extension of time for filing a final plat for the UAW Region 4 located at 1000 East Center Street until Friday, April 3, 2022, be adopted.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution declaring the properties located at 924, 1006, and 1008 W. Marquette Street as public nuisances in the City of Ottawa, be adopted. Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution authorizing the execution of license agreement #5399 between the City of Ottawa and the Illinois Department of Natural Resources, be received and placed on file for public inspection.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Tabled motion/Ordinance.

Moved by Mayor Aussem that the tabled motion regarding a conditional use permit for 950 W. Marquette Street be returned to the table. Be it further moved, an Ordinance granting a conditional use permit for a junkyard with the conditions that no inoperable vehicles be visible from the street, the fence be constructed of a uniform material and color, sea containers in good condition and of uniform color may be used as a temporary screen until the fence is completed, sea containers may be used permanently only on the north side of the property that abuts to the railroad in lieu of a 100% fence, vehicles be prohibited from parking outside of the property boundaries and specifically not in the City’s right of way, meet all State and Federal guidelines for a junkyard, and the fence be completed within 1 year, be passed and approved.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, and Mayor Aussem.

Nays: Less. Motion carried.

Mayor Aussem presented Tabled motion/Ordinance.

Moved by Mayor Aussem that the tabled motion regarding a zoning text amendment to Chapter 118 of the Municipal Code be returned to the table. Be it further moved, an Ordinance amending Chapter 118 of the Municipal Code of the City of Ottawa, LaSalle County, Illinois, regulating rules for recreational cannabis business establishments as follows; cannabis dispensing organizations be a permitted use in Class C-3, C-4, C-5, D & E and all other cannabis business establishments except dispensing organizations be a conditional use in Class C-3, D & E and that no cannabis business establishments be located within 250 fee of a residentially zoned property, and no cannabis business establishments except cannabis dispensing organizations may be located within 1000 feet of a public or private school and cannabis dispensing organizations may be located within 100 feet of a public or private school, be passed and approved.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Request.

Moved by Mayor Aussem that the Request for rezoning for property located at

420 E. Stevenson Road, be received and referred to the Plan Commission for review and recommendation.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Request.

Moved by Mayor Aussem that the Request for a fundraiser from Habitat for Humanity to collect donations on Saturday, April 18, 2020, from 9:00 a.m. until 3:00 p.m. at the intersection of Route 23 and Norris Drive, be approved.

Second by Rodriguez.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Proclamation.

Moved by Mayor Aussem that a Proclamation naming the month of April 2020 as Child Abuse Prevention Month in the City of Ottawa, be adopted.

Second by Less.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented motion to recess.

Moved by Mayor Aussem that this Council recess into Closed Session to discuss matters of personnel and the sale or lease of real estate.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried. Council recessed at 7:20 p.m.

Mayor Aussem presented motion to reconvene.

Moved by Mayor Aussem that this Council reconvene from Closed Session. Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented motion to adjourn.

Moved by Mayor Aussem that this regular meeting be adjourned. Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Rodriguez, Less, and Mayor Aussem. Nays: None. Motion carried. Council adjourned at 7:53 p.m.
