City of La Salle Zoning Board of Appeals met Oct. 19.

Here is the minutes provided by the board:

The meeting was called to order by Zoning Board of Appeals Chairman Bob Thompson at 5:01 p.m.

ROLL CALL

PRESENT: Bob Thompson, Nikki Baer, June Gardner, Sam McNeilly

ABSENT: Mike Schmotzer

LATE ARRIVAL: Larry Happ arrived at 5:08 p.m.

OTHERS PRESENT: Attorney Patrick Herrmann, City Clerk Carrie Brown, Deputy City Clerk Brent Bader, Alderman Tom Ptak, Alderman John Lavieri and Alderman Jim Bacidore, Mr. Michael Robbins

A quorum was present.

Chairman Thompson swore in Mr. Michael Robbins. Mr. Robbins explained that his residence at 901 Gooding Street has no backyard and they have pets. They would like extend their property 9-10 feet to the south to the berm of their yard to install a fence on the east, south and west sides of the property.

Nikki Baer asked if her understanding was correct that they would like a 6 ft. fence on the west and south sides but the east side will be 4 ft. Mr. Robbins replied that ideally they would like the fence 6 feet in height all the way around, but understands the ordinance only allows for a 4 ft. fence in the front yard, which in his case is the east side of the property. Alderman Lavieri stated that he was correct in his understanding that the fence can only be 4 feet in the front yard.

Chairman Thompson asked if there was any other construction involved aside from setting posts. Mr. Robbins confirmed that there will be no other construction taking place other than the setting of posts for the fence.

June Gardner asked if the fence would cause any issue with the stop sign. Mr. Robbins stated that it would not. Nikki Baer added that the City Engineer also expressed that he had no issues in regard to visibility.

Sam McNeilly asked Mr. Robbins how far off the sidewalk the fence would be. Mr. Robbins replied that it would be 2-4 feet off the sidewalk and 41 feet from the center of the road.

Chairman Thompson reminded Mr. Robbins that the decorative side of the fence must face out. Mr. Robbins explained that it is a white, vinyl fence, so both sides are the same.

Chairman Thompson then asked that the legal notice published in the paper be included in the record as Exhibit #1.

Chairman Thompson stated that the City Council could allow a 6 ft. fence on the east side, but that would be up to their discretion. He asked Mr. Robbins to attend the City Council meeting at 6:30 p.m. as the Zoning Board makes a recommendation, but the City Council has the final say.

There were no objectors present and no further questions.

It was moved by June Gardner and seconded by Sam McNeilly to grant the petitioners request for a variance from 4’ to 6’ for a fence on a portion of the west side and on the south side of the premises and to allow for the installation of a solid, privacy fence on the east, south and a portion of the west sides of the premises located at 901 Gooding Street.

Nays: None 

Absent: Mike Schmotzer

Motion carried 5-0

Moved by Larry Happ and seconded by Sam McNeilly to recess discussion regarding the Moved by Nikki Baer and seconded by Mike Schmotzer to adjourn the Zoning Board of Appeals Hearing. Voice vote, all ayes. Motion carried.
