Village of Diamond Village Board Met May 11.

The scheduled meeting of the Diamond Village Board was held at 6:00 p.m. with Mayor Teresa “Terry” Kernc presiding. Upon roll call Commissioner’s present were Jeff Kasher and Dave Warner. Face masks along with social distancing was required.
Approval of 04-27-2021 Minutes
Commissioner Warner stated correction needed under Commissioner Warner. Correct absent status to no report since he was in attendance. MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to approve the 04/27/2021 regular meeting minutes with correction and place on file. All Ayes: Motion Carried.
Approval of May 11, 2021 Bill List
MOTION was made by Commissioner Kasher, SECOND by Commissioner Warner to accept the bill list, draw warrants for their amounts and place on file. All Ayes: Motion Carried.
Approval of April 2021 Treasurer’s Report
Mayor Kernc presented the Treasurer’s report. Commissioner Warner had a question regarding the receipt’s column for the Enterprise Zone and TIF. Kernc stated she will speak with Treasurer Wendy Herbert regarding this and let him know. MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to approve the April 2021 Treasurer’s Report and place on file. All Ayes: Motion Carried.

Approval to Appoint Mark Adair as Commissioner of Public Health, Safety and Parks Mayor Kernc thanked Adair for continuing to serve. MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to Approve the Appointment of Mark Adair as Commissioner of Public Health, Safety and Parks. All Ayes: Motion Carried.
Approval to Appoint Addis “Dean” Johnson as Commissioner of Accounts and Finance Mayor Kernc welcomed Johnson back and thanked him for serving. MOTION was made by Commissioner Kasher, SECOND by Commissioner Warner to Approve the Appointment of Addis “Dean” Johnson as Commissioner of Accounts and Finance. All Ayes: Motion Carried.
Approve Ordinance #2021-07, Designating Commissioners Post and Appointing Other Representatives
Mayor Kernc read Ordinance #2021-07. MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to Approve Ordinance #2021-07, Designating Commissioners Post and Appointing Other Representatives. All Ayes: Motion Carried.
Village Clerk Lori Holmes administered the Oath of Office to Commissioners Adair and Johnson
Approve to Appoint Craig Van Duyne as Chairman of the Planning and Zoning Board for a 1-year term expiring April 30, 2022 and Board Member for a 4-year term expiring April 30, 2025
MOTION was made by Commissioner Warner, SECOND by Commissioner Kasher to Approve the Appointment of Craig Van Duyne as Chairman of the Planning and Zoning Board for a 1-year term expiring April 30, 2022 and as a Board Member for a 4-year term expiring April 30, 2025. All Ayes: Motion Carried.
Approve to Appoint Tracy Warner to the Planning and Zoning Committee for a 3-year term expiring April 30, 2024.
MOTION was made by Commissioner Kasher, SECOND by Commissioner Adair to Approve the Appointment of Tracy Warner to the Planning and Zoning Board for a 3-year terms expiring April 30, 2024. All Ayes: Motion Carried.
Commercial Utility Billing
Village Clerk Lori Holmes stated a commercial property owner wanted to know if the minimum bill could be waived due to non-occupancy. Obtaining tenants in the commercial arena takes more time and the minimum bill is high for the owner to pay. After discussion, due to the obligation of the village bonds, a minimum bill must continue to be charged for all property owners of commercial and residential buildings.
Fireworks
Mayor Kernc stated she received a call from someone interested in utilizing the vacant lot on the corner of Route 113 and Daly St. to set up a tent and sell legal fireworks for the upcoming holiday. Kernc stated she does not want residents to utilize illegal fireworks within Diamond, therefore she does not want to promote the sale of fireworks. After discussion, decision was made not to allow the sale of fireworks. An ordinance will be completed for prohibiting the sales of all fireworks in the future.
EZ Living
Mayor Kernc stated EZ Living is utilizing the village sewer system illegally and they have someone living on their premises in a trailer, which is in violation of the zoning of the property. EZ Living did illegally hook up previously which at that time, the village contacted them immediately and charged them for utilizing the sewer system. They were told they could not utilize the property in that manner
from that point on. They also have storage containers on the premise as well as trailers, which are being stored or sold there. Technically, they are running a business at the location and would like this to cease. Kernc stated, they are stealing services, and this must stop. Village Attorney John Gallo stated the property is zoned a B-3. If they are running a business from that location, the parking lot must be asphalted/concreted along with other improvements. After discussion, Gallo will move forward and send a letter of the violations and fine EZ Living for those violations. Gallo stated, these issues are ordinance violations therefore, if they do not pay the fines, the village will move forward with legal action.

Public Works Department Updates
Acting Public Works Supervisor Jim Dunning stated sidewalks have been poured. The generator at the WWTP will be serviced tomorrow. Trucks will be undercoated this week. They are still waiting for the temporary lift station pump from Xylem to be delivered. There is a water leak which is finished water that is getting into the basement of a home on Route 113. Village Engineer Mike Perry will come on Thursday to inspect the issue with Dunning. Dunning presented the need to hire a temporary parttime public works employee. Mayor Kernc stated she would like permission to move forward with the hiring of the temporary parttime employee with the potential for that individual to achieve a fulltime position with the Village. Commissioners were in favor of seeking a temporary parttime public works employee at the pay rate of $13.00 per hour.

Commissioner Adair was concerned with the overgrowth of grass at the Little Caesars location and the commercial property at 2425-65 E. Division St. Mayor Kernc stated Building Administrator Cindy Haywood has reached out to those owners to take care of the matter.

Mayor Kernc stated Buckeye Pipeline has removed the pipes at the property where the location of Gas N Wash will be built, and a site plan draft has been submitted.
