City of Ottawa City Council met Feb. 1.

Here are the minutes provided by the council:

Present: Wayne A. Eichelkraut Jr., Thomas G. Ganiere, James J. Less, Marla K. Pearson and Mayor Daniel F. Aussem.

Absent: None.

Commissioner Eichelkraut presented minutes of previous meeting.

Moved by Commissioner Eichelkraut that the minutes of a regular meeting of the Council of the City of Ottawa, Illinois, held on Tuesday, January 18, 2022, be approved as recorded in the permanent files of the City Clerk.

Second by Less

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Carol Alcorn of Illinois Valley PADS asked the Council to reconsider the Plan Commission’s decision regarding the conditional use permit for the PADS shelter. She also thanked the Plan Commission members for their time and consideration on this matter. Diane Carr also spoke on the same topic and commented about the number of students that would be located within 2 blocks of the proposed location. She added that there is a senior citizen complex close by and no sidewalk on the North side of McKinley Road.

Commissioner Eichelkraut presented Biweekly Salary Payroll.

Moved by Commissioner Eichelkraut that the Biweekly Salary Payroll of January 21, 2022, in the amount of $486,938.72, be approved and warrants issued.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Monthly Expense Report.

Moved by Commissioner Eichelkraut that the Monthly Expense Report of February 2, 2022, showing expenses in the amount of $460,542.15, be approved and warrants issued.

Second by Pearson.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Resolution.

Moved by Commissioner Eichelkraut that a Resolution authorizing the execution of an amendment to the master service agreement between the City of Ottawa and Foxster Opco LLC, for NCAT’s software, which has been on file for public inspection since January 18, 2022, be adopted.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Eichelkraut presented Resolution.

Moved by Commissioner Eichelkraut that a Resolution authorizing the execution of a memorandum of understanding between the City of Ottawa and Tri County Opportunities Council Community Services Block Grant Program for NCAT, which has been on file for public inspection since January 18, 2022, be adopted.

Second by Pearson.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Ganiere presented Quote.

Moved by Commissioner Ganiere that the Quote received from Layne Christensen Company in the amount of $42,925.00 for repairs to Well #14 be approved and paid for from the Water Fund.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried

Commissioner Ganiere reminded that Well #14 had electrical problems.

Commissioner Pearson presented Resolution.

Moved by Commissioner Pearson that a Resolution authorizing the execution of a maintenance agreement between the City of Ottawa and Altorfer Power Systems, for the Police and Fire Station’s generator, which has been on file for public inspection since January 18, 2022, be adopted.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Pearson presented Resolution.

Moved by Commissioner Pearson that a Resolution authorizing acceptance and execution of a proposal by Alpha Controls & Services, for the Police and Fire Station’s HVAC, which has been on file for public inspection since January 18, 2022, be adopted.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Pearson presented Resolution.

Moved by Commissioner Pearson that a Resolution appointing, approving, and authorizing the execution of an employment agreement for an appointed City Official in Dave Marvin as Playground and Recreation Director, which has been on file for public inspection since January 18, 2022, be adopted.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Less presented Report of Police Chief.

Moved by Commissioner Less that the Report of Police Chief, Brent A. Roalson, for the month of January 2022, be received and placed on file.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Less presented Report of Fire Chief.

Moved by Commissioner Less that the Report of Fire Chief, Andrew Borkowski, for the month of January 2022, be received and placed on file.

Second by Pearson.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Commissioner Less presented Resolution.

Moved by Commissioner Less that a Resolution authorizing the execution of a memorandum of understanding between the City of Ottawa and AFSCME Local 2819, regarding Police and Fire Office Coordinators, be received and placed on file for public inspection.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Report of Registrar.

Moved by Mayor Aussem that the Report of Registrar, Shelly L. Munks, for the month of January 2022, be received and placed on file.

Second by Pearson.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Report of Parking Administration.

Moved by Mayor Aussem that the Report of the Parking Administration Department showing fines collected of $2,130.00, for the month of January 2022, be received and placed on file.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Report of Building Official.

Moved by Mayor Aussem that the Report of Building Official, Mathew W. Stafford, for the month of January 2022, be received and placed on file.

Second by Less.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance declaring surplus revenue in the Ottawa North TIF District special tax allocation fund and authorizing payment of that surplus revenue to the LaSalle County Treasurer for distribution to affected taxing districts on a pro rata basis, which has been on file for public inspection for public inspection since January 18, 2022, be passed and approved.

Second by Eichelkraut.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance declaring surplus revenue in the Ottawa East TIF District special tax allocation fund and authorizing payment of that surplus revenue to the LaSalle County Treasurer for distribution to affected taxing districts on a pro rata basis, which has been on file for public inspection since January 18, 2022, be passed and approved.

Second by Less.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance approving and authorizing the execution of a tax increment financing redevelopment agreement between the City of Ottawa and Ottawa Plant Food Inc., be received and placed on file for public inspection.

Second by Ganiere.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Ordinance.

Moved by Mayor Aussem that an Ordinance granting variances from the City of Ottawa’s Stormwater Management Ordinance to the YMCA for property located at 411 Canal Street, be passed and approved.

Second by Pearson.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution reappointing George Cary, Bob Eschbach, Earl Lecki, and David Rabideau, terms to expire January 2025, all to the Historic Preservation Commission, be adopted.

Second by Less.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Resolution.

Moved by Mayor Aussem that a Resolution designating representatives of the City of Ottawa for collective bargaining in the Mayor, Commissioners, and Corporation Counsel, be adopted.

Second by Less.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem then commented on the next agenda item. Since Heritage Harbor is a newer subdivision, he was contemplating sending the request back to the ZBA for reconsideration, as we do not want the other homes without garages all requesting variances.

The property owner Mylynda Moore then asked to speak. She added that the first 6 homes were the only ones without garages and her lot was a corner lot. She passed around 2 pictures of her home. One showed the home with a garage attached. Commissioner Ganiere asked when she purchased the home. She replied in July of 2021. Mayor reconsidered and proceeded with the approval motion.

Mayor Aussem presented Report of Zoning Board of Appeals.

Moved by Mayor Aussem that the Report of the Zoning Board of Appeals meeting held on Thursday, January 20, 2022, considering setback variance requests from Mylynda Moore for property located at 1 Windward Way, be received and placed on file. Be it further moved, the Council concur with the recommendations of the Zoning Board of Appeals and the front and side yard setback variances to construct an attached garage be granted and the follow up Ordinance be passed and approved.

Second by Pearson.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Report of Plan Commission.

Moved by Mayor Aussem that the Report of the Plan Commission meeting held on Monday, January 24, 2022, considering a conditional use permit request for a homeless shelter from Illinois Valley PADS for property located at 401 E. McKinley Road, be received and placed on file. Be it further moved, the Council concur with the recommendation of the Plan Commission and the conditional use permit request be denied and the follow up Ordinance be passed and approved.

Second by Ganiere.

Commissioner Eichelkraut thanked Brent Barron and the whole Plan Commission for their time on this request. He received a lot of emails and opinions on the proposed location. And even though a handful of PADS clients work at Sigan, the soap factory, he feels there is a better place for it somewhere else in town. Commissioner Ganiere said he supports PADS and is committed to working with PADS for a different location. Commissioner Pearson agreed with Ganiere and stated that she received many emails and agreed the McKinley lot wasn’t the best location. The Mayor added that since the deed restrictions are now removed from the current location, a tear down and rebuild is a possibility. Everyone was in agreement to help PADS.

Mayor Aussem presented Report of Plan Commission.

Moved by Mayor Aussem that the Report of the Plan Commission meeting held on Monday, January 24, 2022, considering a conditional use permit request for a cannabis testing facility from Delta 9 Labs Steep Hill Illinois for property located at 130 E. Madison Street, be received and placed on file. Be it further moved, the Council concur with the recommendation of the Plan Commission and the conditional use permit request be granted and the follow up Ordinance be passed and approved.

Second by Less.

Ayes: Eichelkraut, Ganiere, Pearson, Less, and Mayor Aussem.

Nays: None. Motion carried.

Mayor Aussem presented Report of Plan Commission.

Moved by Mayor Aussem that the Report of the Plan Commission meeting held on Monday, January 24, 2022, considering a conditional use permit request for dwelling units at ground level from CL Real Estate Development for property located at 815-817 Columbus Street, be received and placed on file. Be it further moved, the Council concur with the recommendation of the Plan Commission and the conditional use permit request be granted and the follow up Ordinance be passed and approved.

Second by Pearson

Mayor Aussem announced that the Port District received a letter saying that they were awarded a $9,700,000.00 grant to relocate the switchyard, which causes the trains to be backed up in our City. The rail study, done in conjunction with IDOT years ago, helped with our application. Secondly, we also received notification of receiving a $4,500,000.00 grant for Stevenson Road’s reconstruction. This will include curb, gutter, and sidewalks. A survey is also available to start a new passenger service train from through Peoria through Central Illinois. The survey is available on the City’s website.

Moved by Mayor Aussem that this regular meeting be adjourned.
