A REGULAR MEETING OF THE OGLESBY CITY COUNCIL WAS HELD AT CITY HALL. THE MEETING WAS CALLED TO ORDER AT 7:00 P.M.

PRESENT: COMMISSIONERS ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, MAYOR RIVARA AND CITY CLERK AMY EITUTIS. CITY ATTORNEY BARRY WAS ABSENT

A MOTION IS MADE BY CURRAN, SECONDED BY ARGUBRIGHT to Refer request to the Planning Commission for Amendment to the Zoning Map made by Nathan and John Senica. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA. Commissioner Curran asks what the request is and states he has no issues with the request. Commissioner Curran states he will not vote for anything further until the issues addressed on April 17th are addressed.

A MOTION IS MADE BY EUTIS, SECONDED BY CURRAN to Approve Intergovernmental Agreement Between the Illinois Department of Healthcare and Family Services and the City of

Oglesby DBA Oglesby Volunteer Ambulance Service. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA. Commissioner Argubright questions what the intergovernmental agreement is and Commissioner Eutis gives an explanation.

A MOTION IS MADE BY ARGUBRIGHT, SECONDED BY CURRAN to Approve request from We Are Oglesby to use city, cement utility poles for scarecrow displays from October 1- November 5, 2022 for businesses and residents along Walnut Street. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA.

A MOTION IS MADE BY CURRAN, SECONDED BY ARGUBRIGHT to reject the bids for construction of parking located at 238 E. Walnut Street Oglesby, Illinois. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA. Mayor Rivara states that two bids (for the parking lot) were opened this morning (09/19/2022) and were approximately $25,000.00 – 30,000.00 higher than the estimate. Advanced Asphalt submitted a bid in the amount of $74,565.00 and SKI Sealcoating of Lasalle submitted a bid in the amount of $79,999.00. Mayor Rivara suggests tabling the bids and rebidding the project next Spring. Commissioner Curran comments that the bids are higher than anticipated. City Clerk Eitutis states a discussion of changing the project from asphalt to concrete was had at the bid opening.

A MOTION IS MADE BY CURRAN, SECONDED BY ARGUBRIGHT to place on file all bids for tree removal at the Wastewater Treatment plant. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA. Mayor Rivara states three bids were submitted. They were Clean Cut Tree Service from Grayslake; their bid was $218,400.00. Homer Tree Service from Lockport bid $134,662.97 and Shearer Tree Service bid $247,500.00. Commissioner Curran states that estimate was around $108,000.00 and thought it to be low. Commissioner Curran states it is approximately 25% and states the city has a few years but wants to be “shovel ready” in order to be able to look at all of the maximum financial options. Commissioner Curran questions if ARPA funds can be used for this project? The City Clerk states she will look into it.

A MOTION IS MADE BY CURRAN, SECONDED BY EUTIS to place on file quotes from Clegg Perkins in the amount of $35,326.00 and Traffic Control Corporation in the amount of $26,431.00 for replacement traffic light control box. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA. Commissioner Curran discusses the quotes provided to the Council. Commissioner Curran begins with discussing the traffic light located near IVCC. Commissioner Curran states that light was hit by lighting and is 99.9% certain replacement costs will be covered through the city’s insurance carrier. Commissioner Curran has two quotes, one which doesn’t cover installation. Commissioner Curran recommends placing the quote for Clegg Perkins in the amount of $35,326.00 on file. The second quote is for Traffic Control Corporation. Commissioner Curran explains the stop light located at Walnut & Marquette Avenue and the issues and problems that need to be fixed. Commissioner Eutis states that ARPA funds can be used for this repair. Mayor Rivara questions if parts are available? Commissioner Curran states the Electric Department is currently buying parts off of E-Bay to make the necessary repairs. Commissioner Argubright questions if the parts on the quote are in stock and suggests repairing both stop lights. Commissioner Curran asks the Council if they would like to place

A MOTION IS MADE BY EUTIS, SECONDED BY CURRAN to table the matter regarding the issuance of liquor licenses. AYES: ARGUBRIGHT, CULLINAN, CURRAN, EUTIS, RIVARA. Mayor Rivara starts a discussion on the remaining open liquor license and asks the Council if they are interested in making a change to the current ordinance? Commissioner Curran states that he spoke with the Mayor of Granville and states their availability is kept at zero, by doing so they have control over who can obtain a liquor license. Commissioner Eutis states he agrees with that. Mayor Rivara agrees with the Council having control over who gets a liquor license. Commissioner Argubright states that in order to get a liquor license you do have to have a background check. Commissioner Curran recalls business owners not wanting any more bars coming to the city (not quoted 100% as he was not certain of what exactly was said) as it would take away from existing businesses to which Commissioner Eutis agrees with the recollection. Mayor Rivara states he believes the Council is saying that in order for any new licenses to be issued they would have to come before the Council. Commissioner Argubright questions if a business were to sell to someone would they have to come before the Council? The Council discusses what a reasonable amount of time would be to reissue a liquor license. Mayor Rivara states he does not want to put an undue burden on a business. Commissioner Curran feels there is a difference between a business changing hands versus completely shutting down for a period of time. Commissioner Curran likes the idea of a business coming before the Council to obtain a liquor license. Commissioner Eutis feels it could de-value the businesses property if they were not guaranteed they could obtain a liquor license. Commissioner Eutis feels 90 days would be reasonable for a renewal of a liquor license. Commissioner Curran discusses a previous situation. Mayor Rivara suggests tabling the matter and seeking the advice from the City Attorney.

A discussion is held amongst the council to allow for Tropical Sno to have their food truck in Oglesby during the summer of 2023. Mayor Rivara states it may be too soon regarding this matter and asks where the business would like to park their “food truck” to which the City Clerk responds the original request was to have it located in the City Parking lot. Mayor Rivara asks if the current ordinance would have to be revised. Mayor Rivara states more information would be needed. Commissioner Curran questions that the food truck ordinance was “revamped” to which the City Clerk states it was, but the ordinance was placed on file but was never put on the agenda for further action. The City Clerk states the original ordinance and minutes were placed in the council’s packets. Commissioner Eutis states he would not be in favor of allowing any food trucks that could potentially take away business from the brick-and-mortar businesses. Commissioner Curran states the council was advised by the previous attorney to not take each applicant on a case-by-case basis. Mayor Rivara suggests moving on.

Old Business: Commissioner Eutis discusses the lateral transfer process that is being established within the Oglesby Police Department. Commissioner Eutis states an ordinance will need to passed and then the matter would be passed along to the Fire & Police Commission and is hopeful to keep the process moving along. Commissioner Eutis states there are potentially three or four laterals that are interested and asked Chief Hayse how many applications were taken out to which Chief Hayse states four were taken out and two have been returned so far. City Clerk states it may an issue getting the ordinance on the next agenda, with the City Attorney being out of town.

Argubright: none

Eutis: Commissioner Eutis discussion the city of Oglesby Police officer’s using the fitness center at IVCC and states the college has approached the city with an MOU (Memorandum of Understanding) for those wanting to use the Fitness Center. Commissioner Eutis states the MOU only addresses the School Resource Officer being the only one able to use the facility. Commissioner Eutis states he will get clarification on the matter. Commissioner Curran states there are several officer that are qualified to be an SRO and Commissioner Eutis states he would like the option available to all members of the Police Department. Commissioner Argubright asks about reimbursement for fitness? To which he is told the city does. Mayor Rivara confirms that. Chief Hayse states that the employee must show proof of a certain number of visits and then is eligible for full reimbursement.

Cullinan: none

Curran: branch chipping will begin the week of October 17, 2022 and leaf vacuuming will be the week of October 24, 2022. Hydrant flushing will be the week of October 17-21, 2022. An update on the EZ valves is given. Commissioner Curran states he does not have final figures for the pipes for the well and stats that most of the pipes are reusable. Sandblasting at the Iron Plant is wrapping up as well. Once cured, the resin can then be put in. Mayor Rivara says something (inaudible). Commissioner Curran states he does not like to report on anything that is not planned to be an outage.

Mayor’s: The second payment of the ARPA in the amount of $242, 162.63 is on it’s way. The City received a Quit Claim deed regarding the Butkus property located at 620 S. Columbia Avenue. Mayor Rivara is hopeful the back half of the property will be cleaned up soon as well. Mayor Rivara thanks everyone involved who helped make the Boots, Brews and BBQ event a success. 50/50 tickets are now on sale and is starting out with a $5,800.00 and Mayor Rivara is hoping to get the jackpot up to $20,000.00 by Summer Fun Fest. The City has been trying to host a Municipal Band concert but the weather has not been cooperating and the City has been looking for a place to host an indoor concert. Mayor Rivara states Ameren will be working on a transmission and is hopeful there will be no service interruptions. The IMEA states the city is getting closer to obtaining their 2nd feed. The city’s dispute with Ameren failing to pay the City of Oglesby the utility tax may end up in court. Ameren is requesting the ordinance that confirms IVCC is annexed into the city.
