Coal City Planning and Zoning Board met May 1

Here are the minutes provided by the board:

At 7p.m. on Monday, May 1, 2023, in the boardroom of the Village Hall, chairwoman Maria Lewis called the meeting of the Planning and Zoning Board to order. Roll call-members; Jill Breneman, Richard Crotteau, John Hawkinson, Walt Mahaffey, Amanda Burns and Maria Lewis. Also in attendance were Trustee Dave Togliatti, Matt Fritz, village administrator and Kyle Watson, deputy building inspector. 

The minutes of the April 17, 2023 meeting were reviewed. Lewis requested an addition to the minutes. Burns moved to accept the minutes with the revision, second by Hawkinson. Roll call-Ayes; Breneman, Crotteau, Hawkinson, Mahaffey, Burns and Lewis. Nays; none. Motion carried. 

In the public comment, Mr. Mahaffey indicated to the board that Mr. Wayne Smith, 75 Barney Way is in attendance regarding his shed variance which was presented at the April 17, 2023 meeting. Mr. Smith, being hearing impaired was allowing Mr. Mahaffey to speak on his behalf. Mahaffey stated that Smith wants to keep the shed and is willing to take the board's considerations and implement them in order to keep it. Mahaffey visited the residence and found the following: 

-6' privacy fence hides the shed except the top foot 

-Plywood decorative siding has been added and he will paint current shed and new shed the same color 

-Smith would like to have a list of things he can fix to possibly keep the shed 

The board decided to continue the conversation later in the meeting so another resident could present their scheduled variance request. 

ZONING BOARD OF APPEALS 

PRESENTATION 

Deck Variance

Mr. Fritz explained that there are concrete steps next to the current deck, which Athanasopoulos stated would be removed and the deck would come out and wood steps would be added. 

Ms. Lewis questioned the current structure which showed a 2 x 8 holding the deck in place. Watson stated this method did not cause any construction issues. Athanasopoulos indicated that lattice would be added around the bottom to keep the animals from going underneath. Also discussed was if the deck encroached on the 25' set back. The owner presented the board with a drawing with all of the dimensions which explained the set backs and that it would be roughly 15'. 

Watson stated that front yard and corner side yards are not allowed to have a deck, which is why he needs the variance. Even though he is encroaching on the set back the vision triangle is not affected. The board discussed the code regarding deck versus porch and the petitioner's house is set back 21 1⁄2 which doesn't allow for much room. The area within which the deck is built is in line with other homes due to minimal set backs found along Gordon Avenue. 

Hawkinson stated that he lives close to Athanasopoulos and therefore would not vote on this variance. Lewis agreed. 

There was discussion regarding adding a railing to the deck; Watson stated if the deck is under 2ft. a railing is not required. The resident stated he had hired someone to build the deck and was told by this person a permit would be retained but it never happened, which is why he is now petitioning for the variance. 

The public hearing is set for Monday, May 15, 2023 at 7pm. 

Mr. Fritz, distributed pictures of the shed at 75 Barney Way so the board could further discuss the subject of Mr. Smith's inquiry from Public Comments. Mr. Mahaffey stated the following items which he discussed with Smith. 

-Siding was removed from current shed so he created the look of one shed and paint it all one color 

-Exterior plywood is currently on both sheds 

-Lattice around the bottom so rodents cant access underneath the shed 

-Would like to not pour a pad 

-Shed is currently on the lot line butted against the fence 

-White pipe from sump pump goes underneath shed to the catch basin to keep from flooding the neighbors 

The board discussed and Mahaffey wrote down a detailed list of a minimal list of items which must be completed but would not guarantee approval of the variance upon proper consideration. The following items were listed: 

-Hardship - Already built and he is an older gentleman 

-Old shed and new shed anchored to the ground with the same method such as Triangle anchor system 

-Roof lines on both sheds must be the same - gable throughout 

-Structure must have fire-rated wall 5/8" on the fence line side 

-Lattice underneath for animals 

-Paint or side both sheds for uniform appearance 

Mahaffey gave the list to Mr. Smith and explained to him the discussed items. He was also told this would be considered his new presentation and he will have to go into the village and fill out a new variance request and mail certified letters to all adjoining neighbor's a notice of public hearing. Also, make sure this is published in the newspaper on time. 

Ms. Lewis started discussion regarding text amendments in the Residential Guidelines. 

Matt indicated there is limited information in the guidelines regarding newly established multi- family subdivisions. He stated that the board may want to review the guidelines and bring any changes or updates back at another meeting or could potentially hire a company to do a complete review as it was done when the last guidelines were completed. 

Ms. Lewis referenced several issues within the existing guidelines to be discussed such as: 

-Greenspace 

-Sidewalks 

-2 car parking for duplexes 

-Parking for Tenant situations 

-Fire Ratings 

-Parks 

The board decided that everyone review the guidelines and return to another meeting with any changes or updates. 

Mr. Mahaffey moved to adjourn the meeting, second by Burns. All in favor and meeting was adjourned at 8:01p.m.
