Coal City Planning and Zoning Board met July 17.

Here are the minutes provided by the board:

At 7p.m on Monday, July 17, 2023, in the boardroom of the Village Hall, chairwoman Maria Lewis called the meeting of the Planning & Zoning Board to order. Roll call-members; Cody Krug, Jill Breneman, Richard Crotteau, John Hawkinson, Walt Mahaffey, Maria Lewis. Also in attendance were Trustee Bill Mincey, Matt Fritz, village administrator and Kyle Watson, deputy building inspector. Absent; Amanda Burns.

The minutes of the June 19, 2023 meeting were reviewed and approved with changes. Hawkinson moved to accept the minutes with corrections, second by Crotteau. Roll call-Ayes; Krug, Breneman, Crotteau, Hawkinson, Mahaffey and Lewis. Nays; none. Absent; Burns. Motion carried.

There was no public comment at the meeting.

ZONING BOARD OF APPEALS

Continuation of Public Hearing from June 19, 2023

Shed Variance - 15 W Walnut - Jackie. Siebersma

Lewis indicated there were reports received from the Coal City Fire Chief and Darrell Olson, Public Works Director for Coal City for this property. Lewis asked Siebersma if the shed has been anchored and she answered yes. Lewis indicated they still must discuss the lot coverage and the set back wall variance needing the fire wall separation. Lewis asked the board if there were any questions.

Hawkinson wanted to know if adding the firewall protection facing the garage and ceiling was adequate due to its extreme close proximity to the other two sidewalls as well. Mahaffey indicated that he spoke with Nick Doerfler with the Fire Department and it was Mahaffey's understanding that if the shed were to catch on fire, it would be likely that the garage would also, however, the primary structure is still separated by 10' from the garage.

Crotteau mentioned his confusion and concern about the measurement of the garage to the shed. Watson indicated that the edge of the overhang of the shed is less than 1⁄2 a foot from the overhang of the garage. Lewis asked if there was electricity to the shed and what the shed is used for. Siebersma indicated there was no electricity and it is for storage.

Fritz inquired about the distance of the shed wall to the garage wall. Watson stated he would estimate around 5'. Crotteau stated that eased his mind about the measurements.

There were no further questions from the board. Mahaffey moved to allow a variance from the code requiring a 10′ set back between structures with the condition that 5/8" drywall be installed on the north side wall and ceiling of the shed to create adequate fire protection and the shed's placement within the interior side yard exceeding the 65% open space request by 15% allowing 50% lot coverage to remain, second by Breneman. Roll call-Ayes; Krug, Breneman, Crotteau, Mahaffey, Lewis. Nays; Hawkinson. Absent; Burns. Motion approved.

The next meeting will be for final approval at the Village Board on July 26, 2023 at 7pm.

PRESENTATION

Garage Addition Variance 880 E. 5th Street - Terry Halliday

Fritz explained this garage is located in the Old Eileen neighborhood at 5th Street and Third Avenue. Halliday presented the board with a print for the build. Fritz indicated the reason it has been. brought to the board is although the corner side yard, which is the front of the house exists they are going to expand on a non-conformity. Halliday is not going to go any farther forward into the corner side yard towards Third Avenue, but will be towards the rear lot line but not beyond what would be allowed for a detached garage.

Halliday indicated that he wants to add to the garage to not only make it more appealing but more sellable.

Hawkinson asked if Halliday would be ripping out the existing side wall to make it a two car garage. Halliday indicated that there is currently one 9' door but it shall be replaced with a 16' door. The addition to the garage is 8 feet.

Lewis stated that the public hearing for the garage variance will be on August 7, 2023 at 7pm.

PRESENTATION

Fence Variance-250 S. Short - North Cantrell

Lewis indicated the variance has similarities to one that the board approved on Joseph Court in the same subdivision of Meadow Estates in 2022. Lewis shared this so the board had something to compare the current variance limiting the total variance to be requested for allowing a fence in the corner side yard.

Mrs. Cantrell indicated that she wanted to fence in the area for her dogs and a garden and would like to be able to utilize as much space as allowed by the board so they could enjoy their yard.

Mr. Fritz explained he had spoken to Cantrell and what usually happens with cases like this is they are infringing on the neighbor behind them to the west, which is adjacent to the neighbor's front yard. That is the purpose of the corner side yard set backs, to reserve the front yard for the neighbor; so with off set cul de sacs they don't back up to each other which makes it difficult.

Ms. Breneman had questions regarding what the board decided on for the previous residence on Joseph Court. Lewis shared a drawing so that she could get a better understanding.

Mr. Mahaffey inquired about how far back the neighbor's foundation is as well as how large the back yard is. Watson indicated about 25 1/2' set back which is the standard for this builder. Also about 160 ft. to Richard's Street. Mahaffey and Fritz came up with a fence placement which would give the maximum amount of space for their fenced in yard and provided a drawing to the petitioner. Mrs. Cantrell agreed to amend her petition to maintain some setback within the corner side yard, but utilize additional corner side yard along the full depth of their residence beginning at their house set back line.

The public hearing is scheduled for August 7, 2023 at 7pm.

Trustee Mincey expressed his gratitude to the Cantrell's for handling the variance procedure the correct way. This makes for an easier, less messy process for everyone involved.

Lewis stated that she would like Fritz to go over the proper meeting procedures as far as the meaning of abstaining from a vote, tie vote meaning and abstaining from a tie vote, etc. This will give the board a better understanding of how it all works due to some confusion in a past meeting.

Fritz explained the process so the board had a better understanding of how each vote works going forward as well as quorums. Also discussed was public comment at meetings.

Fritz also communicated that he will work on getting meetings set up to revise table 25 and other items.

Trustee Mincey thanked the board for the way they handled Barney Way and was impressed they went as far as they did and he appreciated that.

Hawkinson moved to adjourn the meeting, second by Crotteau. All signified by saying aye. No one opposed. Absent; Burns. Motion carried and the meeting was adjourned at 8:01 p.m.
