Coal City Planning & Zoning Board met Aug. 7.

Here are the minutes provided by the board:

At 7 p.m. on Monday, August 7, 2023, in the boardroom of the Village Hall, chairwoman Maria Lewis called the meeting of the Planning & Zoning Board to order. Roll call-members; Cody Krug, Richard Crotteau, John Hawkinson, Walt Mahaffey, Amanda Burns and Maria Lewis. Also in attendance were Trustee Pamela Noffsinger, Matt Fritz, village administrator, Kyle Watson, deputy building inspector. Absent; Jill Breneman.

The minutes of the July 17, 2023 meeting were reviewed and approved. Hawkinson moved to approve the minutes as written, second by Crotteau. Roll call-Ayes; Krug, Crotteau, Hawkinson, Mahaffey and Lewis. Abstain; Burns. Absent; Breneman. Motion carried.

There was no public comment at the meeting.

PUBLIC HEARING

Garage Addition Variance

880 E. 5th Street - Terry Halliday

Deputy Clerk, Linda Sula swore in all that would be speaking at the Public Hearing.

Mr. Fritz explained the expansion of the existing garage at 880 E. 5th Street, which is north of the home at the northwest corner of 5th Street and 3rd Avenue. The petitioner is requesting the addition in order to fit two vehicles in the garage. The expansion is a total of 8' to the north the full depth of the existing garage in an effort to maintain the required setback from that garage from the adjacent property. The existing garage has a 6' corner side yard setback which would make it an expansion of an existing non-conformity.

The board had a question regarding the entrance of the garage, which is off 3rd Avenue. After some discussion, Mahaffey moved to approve a 19' variance within the corner side yard setback and allow the expansion of a non-conformity at 880 E. Fifth Street, second by Hawkinson. Roll call-Ayes; Krug, Crotteau, Hawkinson, Mahaffey, Burns and Lewis. Nays; none. Absent; Breneman. Motion carried.

The petitioner's variance will go to the Village Board for approval on August 9, 2023.

PUBLIC HEARING #2

Fence Variance

250 S. Short - North Cantrell

Fritz explained at the previous meeting in July the board and the petitioner came up with a consensus of the exact location of where the fence could be placed to give them the maximum use of their rear and corner side yard. This placement will also be less intrusive to the neighbor to the west of them. Mahaffey moved to accept a corner side yard variance as provided by the petitioner resulting in a 15' corner side yard setback along the depth of the house's entirety at which point there will be a straight line from that point parallel to the southwest corner of the residence, to provide a 20' setback at the petitioner's westerly boundary, second by Burns. Roll call-Ayes; Krug, Crotteau, Hawkinson, Mahaffey and Burns. Nays; none. Absent; Breneman. Motion carried.

The petitioner's variance will go to the Village Board for approval on August 9, 2023,

PRESENTATION

Shed Variance

500 E. Battista - Erika Thomas

Petitioner was not present for the presentation. Fritz explained there is a shed in the corner side yard. The new owner of the property believed this was their rear yard since there was an existing fence within the corner side yard. There was a variance approved for the fence a while ago. Watson contacted the new owner letting them know the shed could not be put there. Petitioner questioned this, since there are many sheds in the subdivision in corner side yards. Watson explained to her that each of those residents had to go through the variance process; in order to keep the shed in this location, she must do the same thing.

Watson explained that the petitioner chose this spot due to the neighbor's fence line which decreased in height from 6' down to 4'. The petitioner has small children and the neighbor with the fence has an unfriendly dog and they wanted to block that area of fence with the shed to keep the dog from possibly jumping over it. The shed is a prefabricated and it does meet all other set back criteria. The Public Hearing is scheduled for August 21, 2023 at 7pm.

Lewis inquired about the Ad Hoc meeting with Fritz, Hawkinson and Burns regarding the rewording of Table 25 (Findings of Facts). The members indicated they are working on this and should have information at the next meeting on August 21, 2023.

Burns moved to adjourn the meeting, second by Crotteau. All were in favor, no one opposed. Meeting adjourned at 7:25 p.m.
