Coal City Planning & Zoning Board met Aug. 5

Here are the minutes provided by the board:

At 7:00p.m., August 5, 2024, in the boardroom of the Village Hall, chairwoman, Maria Lewis called to order the meeting of the Planning & Zoning Board. Roll call-Ayes; Walt Mahaffay, Jill Breneman, Jason Peters, Brad Littleton, and Maria Lewis. Also in attendance were, Kyle Watson, building official, Trustee Pam Noffsinger and Matt Fritz, village administrator. Absent; Amanda Burns and Cody Krug. 

The minutes of the August 5, 2024 meeting were reviewed. Brenemen moved to approve the minutes as written, second by Mahaffay. Roll call-Ayes; Mahaffay, Breneman, Peters, Littleton and Lewis. Nays; none. Absent; Burns and Krug. Motion carried. 

There was no public comment at this meeting. 

PRESENTATION - Adam Katavich – Conditional Use at 38 W. Division - Motor Vehicle repair in C-5. 

Lewis explained there was a former business at this address that had a conditional use, however, the building is now being rented to Katavich and the previous conditional use does not continue so he is here to apply for a new conditional use. 

Watson stated there was a fence in the rear property to screen the extra vehicles and items, however the fence is now gone and Katavich will not have anything back there except for his own vehicle. The use will only be for repair of motorcycles and not sales. 

Mr. Katavich explained he has already turned in his notice to the Courant and sent out notification letters to neighbors. 

There were no further questions and Lewis stated the public hearing would be Tuesday, September 3, 2024. 

PRESENTATION - Kerstin Pasteris - Conditional Use at 30 N. Broadway - Recreational Institution within C-4 

Lewis explained Pasteris is requesting a conditional use in C-4, which previously held a conditional use however, the change in business requires a new one. 

Pasteris explained she will be opening an indoor playroom geared toward toddler to pre-school age. This will allow parents to come in with the kids for a 1-2 hour session to allow the kids to play and do activities. Fritz asked if the parents pay for sessions, which Pasteris replied no, this is not a daycare and the parents must stay with the kids the entire time. 3, 2024. 

There were no further questions and Lewis stated the public hearing would be Tuesday, September 

ZONING BOARD OF APPEALS - PUBLIC HEARING - Anthony Pogliano - Variance to allow an addition to the existing detached garage at 370 N. 1st Avenue. 

Linda Sula, deputy clerk swore in those who would be speaking at the public hearing. 

Fritz explained two parcels have been adjoined and this is an existing non-conformity; an increase in size of the garage will require variance due to set back and expansion of the non-conformity. 

The board had a discussion regarding the dimensions for the project to include in the variance request as well as the non-conformity. 

There were no further questions from the board and Mahaffay moved for 370 N. 1st Avenue for a 3' set back within the interior side yard with a 4' variance for a height of 19' and an additional 236 sq. ft. variance for the total structure and a non-conformity variance for code 156.291(B). Watson inquired if a separate variance is needed due to the single structure being over and the total allowable accessory structure is over in sq. footage. Fritz stated it would be lumped together. Breneman seconded the movement. Roll call-Ayes; Mahaffay, Breneman, Peters, Littleton and Lewis. Nays; none. Absent; Burns and Krug. Motion carried. 

Lewis stated this will go to the village board for final approval at the upcoming Village Board meeting.

ZONING BOARD OF APPEALS – PUBLIC HEARING – Alex Kuhel - Conditional Use for RS-3 and Variance for Signage at 215 S. Kankakee (Assumption Catholic Church). 

Sula swore in those that would be speaking at the public hearing. 

Lewis stated that she appreciated the new submittal of plans from Kuhel. Fritz explained the sign will be moved 8 ft. back from the sidewalk and will not block the corner view. The sign will have back lit raised metal letters affixed to the sign. 

Mahaffay inquired about a 5 ft. 6" reference on the new drawing. Kuhel indicated that would be the closest the sides of the sign would ever get to the sidewalk. 

Breneman asked about the height of the sign, which Kuhel stated the posts for the sign will be no higher than 3 ft. and the actual sign will be 2 1⁄2 ft. from the ground. 

The board discussed the variances that would be required. Krug entered the meeting at 7:22 p.m. 

Mahaffay moved for 215 S. Kankakee Street a variance 154.5, 156, 170 G and a conditional use in a residential district, second by Peters. Roll call-Ayes; Mahaffay, Breneman, Peters, Littleton, Krug and Lewis. Nays; none. Absent; Burns. Motion carried. 

Lewis brought up the discussion regarding some changes to the code, which were discussed briefly at the last meeting. The main point of discussion was the height of eaves. After some discussion the board decided to leave the eave height as is. Lewis asked Fritz to proceed with the other changes to the code which were finalized at the previous meeting. Fritz indicated this will be subject to a public hearing and he would get that taken care of and the hearing date will be September 3, 2024. 

Lewis welcomed Jason Peters to the Planning & Zoning Board. 

Lewis asked Fritz to add "signs" to the Remaining Work Items list on the board packet memo. This area in the code needs to be looked at closely and cleared up. 

Breneman moved to adjourn the meeting, all were in favor and meeting ended at 7:46 p.m.
